HomeConcierge™ Terms and conditions: Account Owners and Hosts
Welcome to HomeConcierge™! We appreciate your participation in our program to make your clients' vacations as enjoyable as they can be. We value your contributions to our Applications, and we want to be sure, for our part, that we play a constructive role in serving your Vacation Guests and your business.
Because you are the Account Holder and or Host, we are relying on you to supply all the information related to the property and as needed for use by the Vacationing Guest.
We have given you credentials to access our HomeConcierge™ Applications: The Guide Builder, Guest Application, House Promotional Brochure and House Feature Camera for you and your employees who help us build and deliver the above Home Concierge™ Guide to your Vacation Guests.
(1) License: we own the software. The above software and systems belongs to us, and you have a license to use it. Your license to use them is personal to you/company and your employees and may not be transferred to anyone else. The software will be automatically renewed as long as you continue to host properties with us. Your license may be used only by you and your employees.
(2) Our intellectual property. We are very proud of the way HomeConcierge™ presents information to the Vacationing Guests (our “user interface”). The idea of compiling all the information a Vacationing Guests might need is not new but our expression of that idea is original with us. We call that expression the "user interface" and we view that user interface as our intellectual property. All Home Concierge™ Applications interact with that interface. We have already protected that intellectual property with copyrights and trademark protection. By using HomeConcierge™ Applications you and your employees agree to respect our intellectual property: you will not attempt to copy it, or build other software which imitate it or duplicate its style.
(3) Your privacy. HomeConcierge™ respects your privacy. We do collect information about your usage of our software, but that is only for the purpose of helping us to improve our service. We will not sell or distribute your information -- either the data you supply about yourself, or the information we collect about you - to third parties. The private information you supply regarding the homes you host, remains private an is shared only on a need-to-know basis.
(4) Our privacy. HomeConcierge™ has gone to a lot of work to gather all the information you might need during your stay. That information comes from a variety of internal and external sources: from the homeowner, the realtor, local governments, and advertisers. Except for the information we received from advertisers, all the information in HomeConcierge™. Your agreement with the homeowner and/or their representative are inclusive here. Accordingly, we need you to agree that you will hold that information in confidence and will not make it available to anyone outside of your user group - that is, to yourself and your guests.
(5) Disclaimer of Liability. We rely on you to supply accurate information relating to the properties you host. We try to make sure that all the information we present to your guests is accurate, but we cannot take responsibility for making sure that it is. Nor can we take responsibility for accidents or mishaps that occur at the places we list in our software. So please understand that HomeConcierge™ assumes no responsibility or liability for any errors or inaccuracies that may appear in the informational content contained in our application and is not liable for any loss or damage you or your guests may incur as a result of visiting the venues we list or utilizing their services.
(6) Applicable law. HomeConcierge™ is based in Malibu, California, and this Agreement, and your usage of our software, is governed by California law.
